Terms of Use

1. What FIND:HOME is, and is not

• A software platform. We turn your answers into a draft NSW Contract for the Sale and Purchase of Land, order the prescribed documents from the registry, publish your listing, and give buyers and sellers tools to talk, book inspections and exchange the contract.
• Not a real estate agency. We are not licensed under the Property and Stock Agents Act 2002 (NSW). We do not act for you or for any buyer, we do not negotiate, appraise, market beyond the listing you publish, or hold money on trust, and we do not receive a commission.
• Not a law firm. Nothing on the platform is legal advice. Your contract is finalised by a solicitor you engage: your own, or Wainwright Legal, which is an independent firm with its own terms, fees and professional obligations. Their engagement is between you and them.

2. Your account

You must be 18 or over and give accurate details. Keep your sign-in secure; what happens under your account is your responsibility until you tell us it has been compromised. One person may hold one account; a person can be both a seller and a buyer.

3. The contract service

• The survey asks the questions the NSW standard form needs. You must answer truthfully and completely: the contract is only as accurate as your answers, and you are responsible for them.
• You see the whole draft, watermarked, before you pay. After payment the standard form pages are attached and the unwatermarked contract is generated, usually within one business day.
• Prescribed documents (the title search, plan, planning certificate, sewer diagram and any others your property needs) are ordered from third-party registries at their cost plus our handling fee, shown before you pay. Registries deliver on their own timeframes.
• The standard form contract is the copyright of its publishers and is supplied for use in your transaction only.
• As vendor you carry the disclosure obligations in section 52A of the Conveyancing Act 1919 (NSW) and the regulations. The platform helps you meet them; it does not take them over. Your solicitor confirms the contract is complete before it is used.

4. Fees

• $99 today, then $1,990 at settlement, only if it sells through FIND:HOME. Registry documents are charged at cost plus a handling fee. Your solicitor's fee is separate.
• The $99 contract fee is charged when you buy the contract. Prescribed documents are charged at the time you order them, at a stated maximum, with any saving refunded.
• The $1,990 fee (inclusive of GST) is written into your contract as special condition 99 and is paid from the sale proceeds at settlement, only if the property sells through FIND:HOME as that condition defines. If it does not sell that way, it is not payable. It is a fixed fee, not a percentage, and it is not a commission.
• Solicitors' fees are set and billed by the firm you engage. Refunds are covered by the Refund Policy, which sits under the Australian Consumer Law.

5. Listings, enquiries and inspections

• You may list only a property you own or are authorised to sell, and everything in the listing must be true and not misleading.
• You keep the copyright in your photos and text. You give us a licence to display them on the platform, to people you choose, for as long as the listing is live, and you promise you have the right to use them.
• Buyers' messages are passed to you as written. An inspection booking is a request to view the property and nothing more: it is not an offer, an option or an agreement of any kind, and either side can cancel it.
• You are responsible for who you let into your home. We suggest confirming a buyer's identity and phone number before a private inspection.

6. Buyers

If you use the platform as a buyer you agree to give true details, to treat sellers and their homes with respect, and to understand that a listing is the seller's own description and that any contract you receive is to be reviewed by your own solicitor or conveyancer before you rely on it.

7. Acceptable use

Do not use the platform to mislead anyone, to break a law, to send unsolicited marketing, to scrape or copy listings, to interfere with the service or other people's accounts, or to upload anything you do not have the right to. We can suspend or close an account that does.

8. Third parties

The service depends on providers we do not control: registries and InfoTrack, Stripe, Resend, Google, Meta, Amazon Web Services, Vercel, Render and DocuSign. Their outages and timeframes are not ours to fix, though we will help where we can. Your use of Google sign-in and Google Maps is also subject to Google's terms.

9. Consumer guarantees and our responsibility

• Our services come with guarantees that cannot be excluded under the Australian Consumer Law: that they are provided with due care and skill, are fit for the purpose you told us about, and are delivered within a reasonable time. Nothing in these terms limits those guarantees.
• Where the law allows us to limit our liability for a failure to meet a guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
• We are not responsible for the outcome of your sale, for a buyer's or seller's conduct, for the accuracy of your own answers or listing, for a solicitor's advice, or for delays at a registry.
• Nothing here excludes liability for fraud, or for death or personal injury caused by our negligence.

10. Ending things

You can close your account at any time by emailing us; the Privacy Policy says what we keep and for how long. We can close or suspend an account that breaks these terms, and we will tell you why. Fees already earned are not refunded on closure except as the Refund Policy provides.

11. Changes to these terms

We may update these terms. A change that affects your rights takes effect 14 days after we email account holders about it; other changes take effect when published. If you do not accept a change you can close your account before it takes effect.

12. The law that applies

These terms are governed by the law of New South Wales, Australia, and the courts there have jurisdiction. If part of these terms cannot be enforced, the rest still applies.
